IRS a Corrupt Organization – Ditto Holder Justice

Posted by Tina

The IRS has never been America’s favorite department of government. It is demanding, contentious, and capable of creating high stress and unprecedented cost for taxpayers. The mountain of complex laws that citizens and business alike must attempt to understand every single year in order to pay taxes is ridiculous and costly. All of that is bad enough but when this body begins to politically harass, badger, and restrict citizens, particularly for political purpose, it has crossed a line into corruption.

We are all familiar with evidence of the targeting of conservative organizations filing for non-profit status. That case continues as IT experts claim the so-called “lost” emails can likely be recovered. Republicans in the House are considering legislation to offer $1 million dollars to anyone who does recover significant emails.

But this isn’t the only red flag flying over the IRS. Separate cases have sprung up that might become even more explosive. American Thinker has the story:

In the absence of a special prosecutor, the best opportunity for piercing the veil of secrecy and evasion that surrounds the IRS handling of groups perceived as enemies of the Obama administration lies in civil litigation. The National Organization for Marriage has just obtained a $50,000 settlement from the IRS for its criminal release of confidential donor information to an opposition group. But so far Eric Holder’s Justice Department is not pursuing inquiries into who feloniously released that information.

The absence of any official judicial inquiry into the inner workings of the IRS processes is why it is so important to note that yesterday saw the beginning of the discovery phase in the lawsuit by Z-Street a pro-Israel organization that was told its application for tax exempt status was being delayed because:

…these cases are being sent to a special unit in the DC office to determine whether the organization’s activities contradict the Administration’s public policies.

Z-Street’s lawsuit alleges unlawful viewpoint discrimination, a First Amendment claim. The IRS tried several arguments to dismiss Z-Street’s lawsuit, all of which were dismissed by Washington, DC federal district court Judge Ketanji Brown Jackson, an Obama appointee. She noted that Z-Street was not suing to gain tax exempt status, but rather over the viewpoint discrimination evidenced by what it was told by IRS agent Diane Gentry about contradicting administration policies – the process by which the IRS made the determination on tax exempt status.

The Z-Street case goes back to an august 2010 filing and from that date the IRS was obligated legally to preserve all records. American Thinker quotes from the WSJ:

In private white-collar cases, companies facing a lawsuit routinely operate under what is known as a “litigation hold,” instructing employees to affirmatively retain all documents related to the potential litigation. A failure to do that and any resulting document loss amounts to what is called “willful spoliation,” or deliberate destruction of evidence if any of the destroyed documents were potentially relevant to the litigation.

At the IRS, that requirement applied to all correspondence regarding Z Street, as well as to information related to the vetting of conservative groups whose applications for tax-exempt status were delayed during an election season. Instead, and incredibly, the IRS cancelled its contract with email-archiving firm Sonasoft shortly after Ms. Lerner’s computer “crash” in June 2011.

What this means for the IRS is that the Z-Street case has the potential to bust the IRS wide open for scrutiny under subpoena and under oath. (See FOX News video)

The IRS has not worked to serve the people but to further the agenda of a politicized administration. Ditto Eric Holders Justice Department. Corruption is rife in DC and it will take extraordinary measures to eradicate the corrupt parties responsible for the worst administration this nation has seen. Ultimately the voters will determine whether we continue down the path to third world status or choose freedom and justice. We have been a nation of laws, not men. The corrupt individuals stomping on our constitutional liberties for fundamental transformation must go if we are ever going to once again become the land of the free.

I do not understand the reluctance to appoint special prosecutors and open grand juries with respect to the IRS, Eric holder, and Benghazi.

Regarding Lois “The 5th” Learner crashed hard drive: Her attorney William Taylor III has announced, “It’s a little brazen to think she did this on purpose.”

It is mildly interesting that he, of course, did not say, “How conveeeeeeenient.”

Pie, Katie Pavlich, TownHall has the answer to your question at #1.

    Tina,

Thanks for the link. (Katie Palvich is one of my heroes, but I completely missed this.) It makes perfect sense that Holder is a corrupt as Lois “The 5th” Learner. So much for Obama’s “open” government promise, the lying, duplicitous, dirty bum and his dirty tricks. A consummate Democrat.

It is my understanding that Congress itself can appoint a special prosecutor and is not dependent upon the DOJ to cooperate.

Pie this judge might just beat them to it! July 10th is the day and he’s a judge that has done this before! He’s got a nonpartisan record too having been nominated for judgeship by presidents of both parties.

    Re #6 Tina:

Thanks! Works for me. We will see.

  8. Pie Guevara says:

    Tina,

If Sullivan does appoint a special prosecutor I expect to see the Democratic Party attempt to destroy his reputation.

    #10 Pie:

Just read the Z Street article and watched the tape. It looks like the case we needed to blow the lid off of the IRS stonewalling.

Since it’s not being covered in the media we all need to keep an eye out for any updates.

    From the Foreword

This book should serve as the beginning of a serious conversation about whether our criminal justice system continues to live up to its vaunted reputation. As citizens of a free society, we all have an important stake in making sure that it does.

    KABOOM!!

We now know why this administration has been so reluctant to provide documents to Congress and respond to FIOA request. A memo was sent out to every department saying all documents were to be sent to the WH first.

Hopefully, this is the lawsuit Boehner is bringing against Obama.

Click on the “memo” link to see the actual memo.

Worse than Nixon? Obama White House accused of hiding public information:
Memo conflicts with Obama transparency promise.

“Though President Obama vowed to run the most transparent administration in history, his White House has quietly empowered itself to censor or delay the release of information in ways that not even Richard Nixon envisioned during the Watergate scandal, according to federal workers on the front lines of processing open records requests.

The workers, who spoke to The Washington Times only on the condition of anonymity for fear of reprisal, said that an April 15, 2009, memo from White House Counsel Gregory Craig to all federal agencies has slowed, and in some cases nixed, the public release of government documents that would have been released under prior administrations.

It also has given the White House the ability to track in real time who is asking for derogatory information about the Obama administration, the workers said.

Mr. Craig’s memo instructed federal agencies that they no longer could release under the Freedom of Information Act documents that contained “White House equities” — essentially any information involving or referencing communications with the White House — without first clearing it with presidential attorneys.

Because the White House is not a federal agency, it is exempt under the FOIA law and, as a matter of general principle, is not supposed to interfere with agency reviews of FOIA requests or the release of federal agency documents, legal analysts say.”
