The morons depicted in this (mostly audio) video are beyond stupid and full of hate. It makes me wonder why they haven’t been arrested for inciting violence, conspiring to commit a felony, etc. Thank God this is only a small bunch of fringe nitwits. But, they do exist. They really need to be locked up before they hurt somebody.
Notice they used the continent of “Africa” in their logo and not the USA? That’s good. I sure wouldn’t want them to be affiliated with this country. They don’t represent anything relevant about us in America, they’re just racist jerks, like the KKK.

Black Panthers & DOJ – Double Standard
Family members of George Zimmerman, the killer of Trayvon Martin, are demanding that Eric Holder’s [In]Justice Department charge the New Black Panther Party with a hate crime for putting a “dead or alive” bounty on Zimmerman’s head. The family is probably wrong in its specifics, but right in the overall principle. The problems with their
specifics are A) that except in very narrow circumstances, the whole concept of “hate crimes” is seriously flawed because it penalizes the same action by different degrees depending on the “thoughts” of the perpetrator, and b) because even under an expansive reading of hate crimes, the bounty probably doesn’t qualify because it is not aimed at Zimmerman because of his ethnicity but rather for revenge.
But that doesn’t mean the Panthers should not be arrested, prosecuted, imprisoned — and ostracized for life. Their bounty appears, almost certainly, to violate numerous state laws, as former Justice Department official and whistleblower J. Christian Adams explained in a great column a couple of weeks ago:
Let’s start with solicitation to kidnap. In announcing a reward for the seizure of Zimmerman, the New Black Panthers may have violated Florida Code 787.01. It makes it a felony to “by threat, confining or abducting, or imprisoning another person against his . . . will without lawful authority with intent to . . . terrorize.”
Merely soliciting someone else to do this is also a felony in Florida under Florida Code 777.04. “A person who solicits another to commit an offense prohibited by law and in the course of such solicitation commands, encourages, hires, or requests another person to engage in specific conduct which would constitute such offense or an attempt to commit such offense commits the offense of criminal solicitation.”

I absolutely agree that the people who put out this “bounty” should be arrested. But the article is right that this probably wouldn’t count as a hate crime. They lose me with this, though:

Almost all of our laws regarding punishment do this same exact thing. Does the author also think that first-degree murder, second-degree murder, and manslaughter should all receive the same exact penalty? If I run someone over with my car as an accident, should I face the same punishment as if I run someone over with my car on purpose?
Chris, yes of course you are right. We have degrees of theft, degrees of murder, degrees of almost everything criminal. So it makes perfect sense to me that if someone commits a crime because of race that is a factor to be considered for the good of our color blind society.
The most racist people are blacks that have been living here for at least a few generations. Their minds have been poisoned and they see racism every 5 feet. I work with people like that and I don’t want to hear it anymore. They are poisoned.

Pardon me, is it not true that each degree of murder is already defined by state of mind? What, exactly, does “hate” crime add to that?
In legal terms, how is the argument “the defendant killed the victim with malice aforethought” differ substantially from “the defendant killed a (insert protected class) with malice aforethought because he had malice towards that (insert protected class)”?
I argue that inserting a protected class is little more than a “feel good” measure and that build a class of laws based on “hate” crime superfluous, arbitrary, and problematic.
When it come to progressive, you just cannot get much more progressive than the Black Panthers.
Ask Eric Holder, who is protecting them by refusing to apply the law to them.
Pie, it’s a valid question, the only thing I can think is that we hold that violence directed at someone over their race is destructive against society more than it is against the individual, it’s like a cancer and society says it must carry the highest possible penalty to make it clear society will not tolerate it. Now thats just my take, I could be way off.
How bout if the angry racist white people who commit “hate crimes” against the happy go lucky, non belligerent African American people were to yell “I love you”, while committing the so called crime?

Fair point, but I still think such legislation is superfluous and arbitrary. It leaves out “hate” crimes not directed at protected classes, thus placing a higher value on some groups at the denigration of others. The wording of hate crime legislation itself may be fairly inclusive, but the application of it not.
For example, Adolf Hitler was a mass murderer. What if someone opened a restaurant in Los Angles called “Adolphs” which was emblazoned with a swastika and an image of Hitler? If it happened to be near a synagogue, would that not be a prosecutable hate crime? I can imagine the reasonable and justified outrage that would follow if businesses were established using swastikas and images of Hitler.
Mao was, unarguably, the greatest mass murderer of all human history. It was so bad that the starving victims of his cultural revolution had to eat their own children to stay alive. Evidently, not many Americans know about Mao. His atrocities, which resulted in the deaths of 100s of millions, are not taught.
There is a restaurant in Los Angeles that uses Mao’s name and image but no one has ever made a peep about it except for a few Asians who live nearby whose families had personal experience with Mao’s horrendous crimes.
Moreover, I don’t see anyone charging The Black Panthers with a hate crime after their violent threats. Heck, the DOJ even refuses to enforce other applicable laws to this group, much less hate crime legislation.
Evidently, some protected classes are more equal than others. Eric Holder should be held accountable and either enforce the law or be made to step down. But that won’t happen. Not with this administration.
Let’s get real, people who swear every other word are usually ignorant, stupid or both. They usually have a limited vocabulary and poor usage of the English language. Then I can say that anyone who calls all incidents between different ethnic groups as being racist fall into the lower IQ and ignorant stupid category. I watch enough documentaries and various interactive TV along with pro sport violent attacks by so called men on others that it is easy to see who has a wild violent arrogant chip on one’s shoulder. I think of the most current NFL incident on players for hire trying to do bodily injury
on others for pay. I hope these ones reap what the sow or maybe a loved one will, think about it big man tough guy as you are really small in the eyes of good people. I no longer go to pro sporting events, I boycott and encourage others to do the same. I cancelled satellite TV and like having the extra money as these players are spoiled over paid knuckle headed hot headed loud mouths, other than those in the Tebow category, he is not perfect just forgiven a believer who professes and strives to live a Christian life style.

I’m generally against hate crimes prosecution. I understand the point you made in an earlier post, Jack, about wanting to make the point that communities will not tolerate targeting people out of hate but I worry about the court prosecuting someone for having thoughts or attitudes. As we are witnessing it’s fairly easy for special groups to be treated differently than others.
I found an interesting study that, from my perspective, makes it seem like many hate crimes are gang or turf related. I’m thinking about LA where black and Mexican gangs are always at each other. Are gang members ever prosecuted for hate crimes?

Thrill seekers would be crimes like those committed by flash mobs (66%). The KKK would fit here and maybe eco terrorists. I can’t think of other examples.
Mission offenders only made up 1% and I would think it is these where Jacks concern for messages sent to the community would be appropriate. Burning churches or synagogues might fit in here.
The other two categories, Defensive, 25%, and Retaliatory, 8%, sound like gang activity to me.
On another note: The charges for Zimmerman were just announced…second degree murder. Waiting to see if he will do as he said he would and turn himself in. The special prosecutor didn’t mention a hate crime to my knowledge.
Holder is working on the hate crimes angle.
