Does this revelation mean the IRS is Caught?

Reason:

The Internal Revenue Service (IRS) said it can’t provide emails sent between 2009 and 2011 that were requested by congressional investigators because of hard drive crashes.

The agency said that emails stored on dead drives were lost forever because its email backup tapes were recycled every six months, and employees were responsible for keeping their own long-term archives.

And yet…

The IRS had a contract with email backup service vendor Sonasoft starting in 2005, according to FedSpending.org, which lists the contract as being for “automatic data processing services.” Sonasoft’s motto is “email archiving done right,” and the company lists the IRS as a customer.

Hmmm…this kind of storage service generally backs up automatically…in the background so to speak. Is the IRS playing dumb or did they forget about the back-up contract…and when will this company be subpoenaed for testimony and records?

    Breaking News…Elijah Cummings Implicated By IRS Email As Person Directing Lois Lerner:

    “I wish I could say I am sorry to hear Rep. Cummings appears to have some MAJOR involvement in the I.R.S. scandal. With all of his incessant pissing and moaning about claims of a partisan witch hunt, and his attempts to stonewall Darrell Issa every time he had the MIC, I hope he is at the top of the list for people to be sent to prison.

    True the Vote founder Catherine Engelbrecht responded Wednesday to reports that Rep. Elijah Cummings’ office may have prompted the IRS to target her group for additional scrutiny.

    “Today’s committee action reveals what we knew all along. Partisan politics and the weaponization of government against opponents of this administration is real and continues,” Engelbrecht said in a statement. “Elijah Cummings has blocked the IRS abuse investigation all along. We now see clearly that two branches of government have colluded to target and silence private citizens.”

    “America has come to a tipping point,” she added. “No more lies. No more cover-ups. No more collusion. Enough is enough. Finally, we have a chance for the rule of law to be re-established, thanks to the bold efforts of Chairman Issa and Rep. Jordan.”

    She concluded: “We filed an ethics complaint against Rep. Cummings in February. Today we’re amending that filing to include this latest revelation. As I have said in my testimony before Congress; I will not retreat, I will not surrender, I will not be intimidated. I will not ask Rep. Cummings, Lois Lerner, Barack Obama, or anyone else, for permission to exercise my constitutional rights.”

    The top Democrat on a House committee tasked with investigating the IRS scandal may have been involved in the targeting of a Texas-based conservative group, House Oversight and Government Reform Committee Chairman Rep. Darrell Issa (R-Calif.) said Wednesday.

    Citing documents obtained last week, Issa suggested in a memo that Rep. Elijah Cummings’ (D-Md.) supposed eagerness to end the IRS investigation may be due to the fact that the Maryland congressman’s office in August 2012 communicated with the IRS about True the Vote, a non-profit group dedicated to preventing voter fraud.

    “The IRS and the Oversight Minority made numerous requests for virtually identical information from True the Vote, raising concerns that the IRS improperly shared protected taxpayer information with Rep. Cummings’ staff,” the Oversight panel said in a statement on its website.

    The communications between Cummings’ office and the IRS included Lois Lerner, the former IRS official at the center of the targeting scandal. However, Issa’s documents show that she didn’t get involved in the True the Vote matter until January 2013.

    The documents obtained by Issa show that Cummings’ staff told the IRS it was interested in obtaining “copies of all training materials used for volunteers, affiliates, or other entities,” from True the Vote.”

    The Internal Revenue Service (IRS) cancelled its longtime relationship with an email-storage contractor just weeks after ex-IRS official Lois Lerner’s computer crashed and shortly before other IRS officials’ computers allegedly crashed.

    The IRS signed a contract with Sonasoft, an email-archiving company based in San Jose, California, each year from 2005 to 2010. The company, which partners with Microsoft and counts The New York Times among its clients, claims in its company slogans that it provides “Email Archiving Done Right” and “Point-Click Recovery.” Sonasoft in 2009 tweeted, “If the IRS uses Sonasoft products to backup their servers why wouldn’t you choose them to protect your servers?”

    Sonasoft was providing “automatic data processing” services for the IRS throughout the January 2009 to April 2011 period in which Lerner sent her missing emails.

    Two observations about the Sonasoft story: first, the IRS’s cancellation of the Sonasoft contract occurred in the context of a $1.8 billion annual budget for information services, plus $330 million annually for “business systems modernization.” All of that, and the IRS couldn’t afford an email archiving service? Not only that, it had to recycle its backup tapes to save money?

    Kinda blows a big wide hole in Libby’s theory that our poor government has not had the resources to upgrade computers but would if only tax payers would “pony up”.

    Clarice Feldman’s amusing piece, “The Good News Democrats” over at American Thinker reminds us how differently official emails were treated in the past by sycophant media supporters of Barack Obama:

    As this plays out, I remembered how differently the subject of emails by public officials was treated when a conservative was involved. Remember how the NYT and Washington Post were so eager to scour Sarah Palin’s emails (which she had retained and which she promptly made available) the Post even published them all and asked people to crowd source them looking for dirt that they never found?

    Every IRS employee that has testified thus far should be charged with contempt of Congress, not just Lois “The 5th” Learner. The entire IRS hierarchy should be investigated by the justice department and be interrogated by a grand jury. The FBI should get off from sitting on their hands and launch a full investigation.

    What “idiot” would cancel the contract just days AFTER claiming to have lost emails on internal back up sources?

    Can’t wait to hear what Sonasoft says.

    Pie, the FBI is as corrupt as the DOJ and all of the other departments under this administrations control. Just look at what happened with Benghazi and all of directors and generals that were transferred or resigned/retired/relieved of command; Panetta, Petraeus, Gen. Ham.

    Koskinen comes off as a smug, arrogant elitist who believes he can’t be touched. This isn’t the attitude the people expect to see from those who serve.

    Still nothing about serving subpoena’s on Sonasoft records and president.

    Tonight’s IRS investigation meeting was revealing, but what is perhaps even more revealing is testimony that will not be revealed (well, not yet anyway).

    On Monday House Oversight Committee Chairman Darrell Issa subpoenaed for testimony White House attorney Jennifer O’Connor, former counsel to the then-acting IRS commissioner. The White House refused to let her appear.

    Fill in the blanks yourself. She won’t be appearing unless a special prosecutor is assigned or a grand jury is convened.

    It was shocking last night to hear Koskinen say during the six month window after Lerner’s hard drive went bad no one thought to preserve the server tapes before they were erased.

    This morning we learned O’Connor, the attorney hired last year for six months to oversee the data collection of Lerner’s emails, was never informed of the missing emails, Lerner’s computer problem, or the servers’ erasing the tapes.

    We also learned Koskinen failed to inform anyone except the WH/Treasury Dept. the tapes were gone. The National Archives and Records Administration (NARA), were not informed, as required by law,

At any time in 2011, through last Monday, did the IRS report any loss of records related to Lois Lerner?

    Ferriero: No.

    Walberg: Is it fair to say that the IRS broke the Federal Records Act?

    Ferriero: They are required, any agency is required to notify us when they realize they have a problem that could be destruction or disposal, unauthorized disposal.

    Walberg: But they didn’t do that?

    Ferriero: That’s right.

    Walberg: Did they break the law?

    Ferrerio: I’m not a lawyer.

    Walberg: But you administer the Federal Records Act.

    Ferriero: I do.

    Walberg: If they didn’t follow it, can we safely assume they broke the law?

    Archivist faults U.S. IRS over missing emails in Tea Party inquiry:


    (Reuters) – The U.S. Internal Revenue Service was criticized by the government’s chief archivist on Tuesday over emails that the tax agency has lost, the latest focus of a Republican inquiry into past IRS treatment of conservative groups.

    U.S. Archivist David Ferriero told lawmakers at a hearing that the IRS did not inform his agency, the National Archives and Records Administration (NARA), as required by law, when it discovered that a former senior IRS official’s computer crash had wiped out some of her emails.

    “When an agency becomes aware of an incident of unauthorized destruction, they must report the incident to us,” he said, adding that the Archivist’s office learned of the lost emails through a letter from the IRS to lawmakers. NARA has a government-wide mandate to keep track of documents.”

    Sonasoft says they don’t have Lerner’s emails, so it looks like this lawless administration will get away scot-free just like it did with Fast and Furious and all of the other scandals unless the voters remember what’s taken place when they cast the ballots.
