Border Crisis – Why Hasn’t Congress Done Something?

elijah-cummings34Why can’t Congress pass a bill to amend the law that is causing tens of thousands of foreign nationals to crash our Southern border?  It doesn’t seem that  complicated.  Congress should be highly motivated to find a fix because we have a monumental human crisis on our hands of their making.  It’s one that  just necessitated appropriating and spending billions of dollars for more manpower on the border, including a callout of the National Guard.

In 2004 President George W. Bush signed a seemingly benign humanitarian sort of bipartisan bill into law (it was co-sponsored by Sen. Dianne Feinstein-D) that transferred the deportation process of illegal immigrant minors to the Dept. of Heath and Human Services.  This resulted in a loop hole and the current catch and release debacle that has flooded us with foreign nationals rushing across our Southern border.

The foreign nationals (minors) illegally entering were of course caught, given a court date to appear for a hearing on possible deportation, and then they just disappeared into that vast portion of our population that is now made up of other illegal foreign nationals, thus overwhelming the system on any number of levels from the courts to welfare to public safety.

Prior to this 2004 change the U.S. Border Patrol expeditiously handled the deportations.  It’s now painfully obvious the 2004 law has created an unmanageable bureaucratic snafu and it’s overwhelmed our legal resources to the point we’re back to an open border for almost anyone trying to gain entry, including narco-terrorists.  We just can’t handle this kind of traffic and Congress knows it only too well.

We need to return to that system immediately, but nobody in Congress is taking leadership and instead they are just appropriating more money to hire temporary guards for the Southern border.

Any representative could introduce a bill to amend the 2004 law, even our local freshman Congressman Doug LaMalfa could introduce an emergency bill to fix this problem.  But, nobody is doing it and of course this includes the person who should be doing it, Speaker of the House, Republican John Boehner.   It Boehner’s job to lead and the Constitution says it’s his prime responsibility to protect America from invasion and this includes the illegal entry of foreign nationals.

Obama is capable of issuing a temporary directive (executive order) too, but he’s showingobama11 unusual restraint on this one.  That’s odd given his past number of executive orders he issued in order to sidestep Congress and pursue his agenda whenever he felt the need.  But, now in a crisis he’s got nothing to say?  Very strange.

The question I pose, is Congress and the President selling us out for their own personal agenda and/or political advantage?

Republicans in Washington know American businesses need a low cost labor force and we need new contributors to keep Social Security afloat too.  On the other side, the democrats in Washington know that new citizens build their ranks, they help them win elections and garner more power while advancing their socialist agenda.  Left out of the equation is the American people. They see jobs and opportunity being diluted by a pool of cheap labor eager to undercut prevailing wages and benefits.

As a result, we see more stress placed on our limited social services that we (taxpayers) paid for to handle our emergencies, not the needs of foreign nationals who sneaked into the country.  We are being victimized by the left and the right and even by illegals themselves.

constitution_2Historians will look back on these days and it will be abundantly clear this type of inaction and resistance in Washington to the will of the American people brought about the creation many grass roots protests and reactionary forces such as The Tea Party, True the Vote and even Occupy Wall Street, to name but a few.

They will note how angry the public was and how deaf Washington was to their demands. In issue after issue, from bailouts to border control the public seethed with resentment and frustration as they watched their nation slide ever closer to the abyss. What is not quite so clear is, will those historians also write, “…and this is how America’s second and most bloody civil war began?”

    Jack, just a couple of corrections to your article. The immigration law signed by Bush was on Dec. 23, 2008, not 2004. And it was to stop the flow of children from central and south America for sex trafficking. This is the law that is preventing the immediate return of the children from those countries. The children and adults from Mexico and Canada can be returned the same day.

    It was Obama’s 2012 EO quasi “Dream Act,” that opened the flood gates that has caused the tens of thousands to come across our border.

    But Obama recently decided to hold off for the time being in seeking new legal authority to send unaccompanied migrant kids back home faster, following criticism that the planned changes were too harsh.

    However, Democratic Sen. Dianne Feinstein of California, an architect of the Wilberforce act, said the White House does not require more authority from Congress to ramp up the deportations process.

    “That law already provides the administration with flexibility to accelerate the judicial process in times of crisis,” she said. “The administration should use that flexibility to speed up the system while still treating these children humanely, with compassion and respect.”

    •El Salvador: from 51.7 to 41.2 (a 20% drop).
    •Guatemala: from 46.1 to 39.9 (a 13% drop).
    •Honduras: from 60.8 to 90.4 (a 49% increase).
    •U.S. (for comparison): 5.4 to 4.7 (a 13% drop).

    Unless all those kids are coming from Honduras, the “violence in Central America” excuse looks like a non-starter.

    And here are some murder rates (per 100,000) in selected U.S. cities in 2011.
    •Camden, NJ: 60.6.
    •New Orleans: 57.6.
    •Flint, MI: 50.8.
    •Detroit: 48.2.
    •Anniston, AL: 47.4.

    I report, you decide. What do you think did it – something Bush did in 2008, something Central America did recently, or something Obama did in 2012 and later?”

      Thanks Peggy, yes, 2008 I wasn’t using my readers and sometimes a 4 looks like an 8 to me if I am not careful. And it’s important to note exactly why Bush signed the law, I said it was done for humanitarian reasons, but you defined it much better.

    In other words Jack, the 2008 Bush law to help the kids who were being trafficked for sex was undone by Obama’s 2012 EO.

    Thousands of kids are arriving now with a name and a phone number and are being turned over to these individual without anyone checking on who they are.

    If they survive the dangerous trip up here how many of these kids will end up in the sex trade is anyone’s guess at this time.

    When questioned about any other casualties, Terrance told us ,”I’m not sure. There were lots of gun shots, and several of my neighbors are still missing. I fear the worse, though I didn’t see anyone physically die.”

    Yes. Obama did deliberately misinterpret the 2008 law. This “crisis” was further engineered by Obama in his delayed deportation (read never) and Dream Act executive actions. Following his policy of letting no crisis go to waste, Obama is now using children as human shields for his real intention to allow open borders. Any Republican who approves any part of Obama’s funding request is a collaborator, since we know Obama will distort and subvert any law passed by Congress.

      Soaps, your points are well founded and I could not agree more. I think Obama has his own agenda in play and it’s nothing good for the American people. Time after time Obama has done incredible things that have only damaged America and this has been well documented. The question is why? Is it because of his incompetence or is he actually succeeding in his plan? Is this really about payback, about hate and he want’s to hurt America? The pattern of conduct and abuse would lend itself to the latter.
