Boston Judge “expressed skepticism” in EO Ban Case

A federal judge in Boston took issue with lawyers claiming Trumps temporary ban is unconstitutional:

Early on Sunday, a magistrate judge in Boston issued an injunction that for seven days blocked enforcement of the order, which the White House has contended is necessary for national security.

“Where does it say Muslim countries?” U.S. District Judge Nathaniel Gorton on Friday asked Matthew Segal, an attorney with the American Civil Liberties Union (ACLU) representing the plaintiffs in the Boston case.

“If your honor’s question is, ‘Does the word ‘Muslim’ make a profound presence in this executive order?,’ my answer is that it doesn’t,” Segal said. “But the president described what he was going to do as a Muslim ban and then he proceeded to carry it out.”

Gorton shot back, “Am I to take the words of an executive at any point before or after election as a part of that executive order?” …

… Judge Gorton on Friday asked U.S. Justice Department lawyer Joshua Press how the seven countries had been selected.

Press responded that the list had come from a law passed in 2015 and amended early last year requiring that citizens of the seven countries apply for visas to enter the United States, “out of concern about the refugees that were coming, mainly from Syria at that time and terrorist events that were occurring in Europe.”

The lawyer, Press, knows he’s projecting his opinion into the order and the judge called him on it and then wisely set a timeframe to allow the dust to settle.

Good news…the process is working. Our republic remains intact.

    Ed Straker of American Thinker says, “‘Muslim ban’ injunction is a judicial coup against President Trump.” He makes his case then concludes:

    Judge Robart, who was appointed by George W. Bush (should we be surprised or not?), has clearly usurped his authority. The case clearly has no plaintiffs with standing or any kind of validity. At most, Judge Robart should have stayed his decision pending appeal to circuit courts. His radical injunction smacks of a judicial coup, of a single federal district judge asserting his authority over the entire executive branch. His arguments for doing so are unconstitutional, as is his manner of issuing the order. We are living in a time when judicial ayatollahs are usurping the power of our elected officials, and it is very much like a judicial coup.

      And since the 9th Circus has refused to hear an appeal of the Seattle’s judge’s ludicrous ruling, perhaps it’s time that the Appeals Court covering Boston should hear the appeal.

    A President who runs a country by issuing 20 Executive Orders in 10 Days and fires anyone who disagrees with him is not a President.

      Yes, people. What do you think about this development in the nation’s foreign policy? Frankly, I like it.

      Over the weekend, I had the misfortune to find out about Dick and Henry’s culpability for the Pakistani massacres in Bangladesh in the early 70s. I could have done without knowing about this one too.

      So, to have The Orange One declare us to be “all barbarians together” is, indeed, rather refreshing.

      Obama did his best to pronounce that every country is the same. He believes no country is special because he thinks that’s an ego thing. But no other country stands for individual liberty or the inalienable rights given by God. We know the ideal can never be realized because human beings are flawed, but we aspire to live up to our ideals and to stand in the world as a beacon of hope for others living in tyranny. This is what Obama does not value and his governance made it obvious.

      I think Trump wants to begin his relationship with Putin on a clean page. Presidents must engage with the world’s leaders. No one asked Secretary Clinton about Putin being a killer. In fact the photo’s of Clinton “resetting” with Russia were positively received by media. Obama, sounding cozy cozy, assured Putin he’d “have more flexibility after the 2012 election.” Has Putin become a different person since then?

      Mountains out of molehills.

          If Obama had said it…wait a minute. Isn’t moral equivilence, in essence, what Obama’s entire presidency was? Obama spent a great deal of time telling the world and the worlds leaders that America was rotten because of slavery, racism, stupid wars, and imperialism…remember the apology tours…:

          Yes, President Obama again found a way to blame the United States for another country’s problems, while visiting that country. He started taking “apology tours” early on in his administration, and he apparently means to keep the tradition going till the end.

          It began on April 3, 2009, a scant two months after taking office. President Obama rushed to France and spoke words that ring preposterous today:

          “In America, there’s a failure to appreciate Europe’s leading role in the world. Instead of celebrating your dynamic union and seeking to partner with you to meet common challenges, there have been times where America has shown arrogance and been dismissive, even derisive.” …

          … But worse—much worse—is that, in Cuba, Obama asked Cubans to forget not just what’s happened in the past, but what it is happening right now. …

          …In fact, on Cuba, the President seemed to be under the illusion that “reconciliation” is underway. He mentioned the word five times in his speech to the Cuban people.

          In the first mention the President said, “I’m hopeful for the future because of the reconciliation that’s taking place among the Cuban people.” …

          … The government continues to deny the most fundamental human rights to the 11 million who have not been able to escape the island. Indeed, dissidents described to me how they were arrested, hit and threatened while Mr. Obama was in on his visit to Cuba. …

          … Cuba’s military dictatorship has been in place since 1959 and has been run by only by two men, first Fidel Castro and now his brother Raul. They have taken a rich country and turned it into a pauperized command economy. The Cuba Archive Project, which meticulously records deaths and disappearances on the island, puts the number of dead so far at over 7,000, in a population that is now down to 11 million.

          Cuba-America, it’s all the same…a patently false narrative pushed softly but distinctly by Obama.

          So what’s your beef? You should be thrilled that Trump admits to America’s failings.

          Trump will always be wrong no matter what he does as far as you’re concerned. The truth is we will have to wade in a bit more than two weeks to see how history judges his term(s) in office.

            No, he did not. He never said America was “rotten.” You are making that up.

            I remember the false accusations of an apology tour, which was roundly rejected by all fact-checkers and everyone in the reality-based community. He never “apologized.”

            And still none of this explains why you are OK with Trump saying that Americans are a bunch of killers no better than Russia. You calling other people hypocrites does not make you any less of a hypocrite. Your stance is nothing but “Liberals don’t have standards or principles, so I don’t have to either.” How cynical.

      This is nonsense. How about you address the issue? the contradiction? Trump’s dismissal of Pooty’s barbarous territorial incursion with a “we’re no better.”

      Have we annexed anybody lately? Some people might have called the Iraq invasion an attempt. Didn’t Trump recently make the rather audacious suggestion that, with regard to Iraq, we should have “kept the oil” … and when BushCo swore up and down that the oil had nothing to do with our incursion?

      Lots to think about, and you really should try.

        Bush’s statements and Trumps statements are not knit together.

        Bush was carrying out a strategy. As I showed you Bush was not after oil, he was about fighting al Qaeda on ME turf and ridding Iraq of it’s brutal dictator in the process. A freed Iraq made it’s own deals for the sale of their oil once they formed their own government…America was not included in those deals. The corrupt UN had a nice little oil for food program going on…got any choice words for that situation? (America also saved the oil fields for Kuwait when Saddam set their oil wells on fire.)

        Trump was expressing frustration…not policy. Better learn to discern the difference or your panties are going to be constantly in a bunch!

        You “think” only inside the boxes of communism and racism, unending circle jerks.

        Let me know when you’re brave enough to actually give thinking a try.

          Tina, your comments are incoherent and give no explanation for why you’re OK with a president saying that we should steal Iraq’s oil and that we’re killers who are “no better” than Russia. The reader is left only to conclude that the only reason you are OK with this is partisan hypocrisy.

            Steal Iraq”s oil? the man is a negotiator. I imagine had he been in Bush’s shoes he might have negotiated for a piece of the oil to pay for our investment in their liberation and newly formed democracy.

            I KNOW had he been in Obama’s shoes he would have negotiated for troops remaining in Iraq to win the peace and complete the mission of completely terrorist elements.

            During a clip of a interview with Fox News’ Bill O’Reilly, set to air Sunday before the Super Bowl, Trump was questioned on whether he respects Russian President Vladimir Putin.

            “I do respect him but —,” Trump started to say.

            “Do you? Why?”, O’Reilly interrupted.

            “Well, I respect a lot of people but that doesn’t mean I’m going to get along with him,” Trump answered. “He’s a leader of his country. I say it’s better to get along with Russia than not. And if Russia helps us in the fight against ISIS, which is a major fight, and Islamic terrorism all over the world — that’s a good thing.”

            He added: “Will I get along with him? I have no idea.”

            O’Reilly shot back: “But he’s a killer though. Putin’s a killer.” (O’Reilly was bating Trump-Trumps weakness)

            “There are a lot of killers. We’ve got a lot of killers,” Trump replied. “What do you think — our country’s so innocent?”

            If you’ve imagined that our nation has not engaged in killing then you are indeed a child. One would hope that the reasons behind what we’ve done justified what was done but it’s undenible that America has made mistakes.

            The way I see it Trump was attempting to have a serious conversation about our relationship with Russia and O’Reilly was going for drama…or ratings.

            Yes, but the reasons that Russia has killed are not justified, unless you think killing journalists who criticize Putin is justified.

            Trump 1) ignores 2) denies and 3) makes excuses for this behavior. If this does not worry you, you do not actually care about our country or its principles.

    I do own it ! I have health insurance that does not depend on the whim of an employer. That is so cool.

    The country does seem to have clawed it’s way back from The Great Recession, with no help, I might add, from that do-nothing Republican Congress we been saddled with for six long years … and which … by the way … STILL does very little of any use to us peasants. They seem content to leave everything to the dictatorial idiot who maketh great noises signifying … very little.
