Federal overseer acts to seize $8 billion for California prison healthcare

SACRAMENTO — The court-appointed overseer for healthcare in state prisons today moved to seize $8 billion from the California treasury, asking a federal judge to hold Gov. Arnold Schwarzenegger and California Controller John Chiang in contempt of court. *** With the state mired in fiscal crisis, J. Clark Kelso, the federal receiver, asked U.S. District Judge Thelton Henderson to force officials to turn over the money he says he needs to raise prison healthcare to constitutional standards. Henderson, who appointed the receiver as part of an inmate lawsuit, has ordered the state to cooperate with Kelso. *** The receiver told reporters today that he took the step “with great reluctance, and yet a sense of firm conviction.” *** “We have fully explored and exhausted every avenue for securing this funding in a manner that least affects California’s budget and immediate cash needs,” Kelso said. “But the state’s leaders have failed to act.” *** Kelso is building seven new facilities for the long-term medical, mental health and dental care of 10,000 inmates, and he is renovating existing clinics at the state’s 33 prisons. This little project, and the lawsuit that spawned it, stinks to high heaven. And constitutional standards”? What constitution and what standards? If he’s talking about Californias Constitution I find it hard to believe it addresses health care in any way for anyone.

Schwarzenegger agreed to Kelso’s plan and included it when he proposed his budget in January. But legislation that would have authorized borrowing for most of the funding was blocked by Republicans in the state Senate in May.

Unless the state has authorized the building of such facilities and the funding for it there isnt any reason to go forward with construction.

Pro-life liberals and the Democratic platform: Steven Waldman, the editor-in-chief of Beliefnet, is disappointed by the abortion plank in the draft Democratic platform. The key linguistic debate has been whether to reduce the number of abortions or reduce the need for abortions, Waldman writes on his Beliefnet blog. Pro-life folks favored the former. Pro-choice folks favored the latter.

Yeah, why not both? Its all about what the language implies. Pro-choicers care about preserving the choice above all.

Riding a Snowboard Down a Steep Mountain

These were my thoughts as I read a story this morning about a small town in Arkansas that has decided to lower the boom on criminals in a poor run down neighborhood. The Mayor, James Valley, along with the City Council ordered a week long 24 hour curfew and authorized police to patrol the neighborhoods and to stop and question those who were found walking the streets:

Crime-ridden Arkansas town expands 24-hour curfew Las Vegas Sun

Officers armed with military rifles have been stopping and questioning passers-by in a neighborhood plagued by violence that’s been under a 24-hour curfew for a week. *** Police Chief Fred Fielder said the patrols have netted 32 arrests since they began last week in a 10-block neighborhood in this small town on the banks of the Mississippi River long troubled by poverty. The council said those living in the city want the random shootings and drug-fueled violence to stop, no matter what the cost. *** “Now if somebody wants to sue us, they have an option to sue, but I’m fairly certain that a judge will see it the way the way the citizens see it here,” Mayor James Valley said. “The citizens deserve peace, that some infringement on constitutional rights is OK and we have not violated anything as far as the Constitution” *** Among the curfew operation’s arrests, 10 came from felony charges, including the arrest of two people carrying both drugs and weapons, Fielder said. The police chief said the officers in the field carry military-style M-16 or M-4 rifles, some equipped with laser sights. Other officers carry short-barrel shotguns. Many dealing crack cocaine and marijuana in the city carry pistols and AK-47 assault rifles, he said. *** “We’ve had people call us, expressing concern for their children,” Fielder said. “They had to sleep on the floor, because of stray bullets.” *** Fielder said officers had not arrested anyone for violating the curfew, only questioned people about why they were outside. Those without good answers or acting nervously get additional attention, Fielder said.

Wait a minuteback up. The Mayor and the City Council have determined they must do something to restore law and order after receiving numerous citizen complaints and now somebody wants to sue? Who might that beand why?

However, such stops likely violate residents’ constitutional rights to freely assemble and protections against unreasonable police searches, said Holly Dickson, a lawyer for the ACLU of Arkansas who addressed the council at its packed Tuesday meeting. Because of that, Dickson said any convictions coming from the arrests likely would be overturned.

This woman lives in the black and white world of the written legal page. She knows the letter of the law. She has a well educated understanding of Constitutionaly guaranteed rights but she brings no practical experience at all to the situations confronting citizens every day in America. Narrowing her focus, she fails to consider the rights of the people in the neighborhood to walk their streets freely or to let their children play in the sunshine instead of huddled inside on the floor.

Holly Dickson has never ridden the mountainshe has only read about it.

Snobal” Warming Summer?

A cold front arriving Thursday could drop some winter-like frosting above 10,000 feet along and east of the Continental Divide, including parts of Rocky Mountain National Park, early Friday morning and night. Around the metro area, Friday may be rainy with a high predicted to plummet to a record-low high of 61 degrees that’s 26 degrees below the normal high of 87 degrees for mid-August.

OBAMA SET TO WIN BY LANDSLIDE?

“(Aug. 13) — From the fever swamps of the blogosphere to the halls of academia, there is a chorus of voices who have come to the same conclusion about the presidential election: Barack Obama is going to win in November, by something resembling a landslide.”

“(I want you all to plug this familiar sounding article somewhere into your memory banks. It was posted by DAVID PAUL KUHN , Politico.com and let’s try to revisit this during just for laughs during our celebration party when McCain is elected. Almost every straw poll I have seen in the past two months shows McCain ahead by a 2 to 1 margin and he hasn’t even gone after Obama yet. Just wait until all the reasons NOT to vote for Obama get mainstreamed and see what happens. Obama is extremely vulnerable as one of the least qualified people ever to seek the presidency. IF the voters are dumb enough to elect somebody like that just because he is black or of Arab decent (which is true, not that it matters one way or the other to me) or just because he is NOT a Republican…then may God have mercy on us all, because we’re sure going to need it. We’ve become a nation of foolish people.

One way to measure a mans worth is to look at his record. In todays troubled world a record of calling the shots right may be one of the most important yardsticks we could use when determining our next president. Investors Business Daily provides a glimpse into McCains experience and record on foreign affairs in an editorial titled McCain’s Experience Shows Through:

McCain has a consistently clear reading on America’s role in the world. He’s seen war up close in Vietnam, and knows the mentality of tyrants and thugs. He also has focused on foreign affairs for decades, helping found Ronald Reagan’s International Republican Institute in 1983, which, along with the National Democratic Institute, has attempted to spread democracy through the world. It’s not surprising that he calls for a league of democracies to replace the stagnant U.N. and ineffective multilateral organizations. *** McCain has been calling Russian intentions right since 1999, when he warned that Vladimir Putin was bad news and said Russia’s strike at Chechnya would in time spread to Georgia. *** It was later echoed in his defiant support of the surge in Iraq, which challenged conventional wisdom at the time but has since brought America a real victory in a long war. *** It was also there in 1994, when the former POW defied Republicans to urge the normalization of trade relations with Vietnamgiving President Clinton crucial legislative cover to lift the embargo. Events show he provided America with a vital partner and emerging ally to counter the growing power of China in Southeast Asia. McCain cited that strategic picture in 1994. *** In 1988, he was one of the loudest advocates for Reagan’s missile shield in Europe, bluntly saying that supporters of what was then derisively called “Star Wars” “believe in protecting our security,” while “opponents believe in undermining our security.” Today, with military tests successfully knocking missiles out of the sky, the wisdom of that is obvious, too.

McDonald’s Sued By Muslim’s

Two Muslim-American women filed a job discrimination lawsuit on July 24, claiming that a McDonalds restaurant in Dearborn Michigan would not hire them because they refused to remove their Muslim head scarves, if they were to be hired. Corporations Rarely Pay Income Tax

WARNING: READING THE FOLLOWING COULD RAISE YOUR BLOOD PRESSURE TO UNSAFE LEVELS. BY CONTINUING ON YOU ARE CERTIFYING THAT YOU CAN HANDLE IT.

WASHINGTON (Aug. 12) – At least 2/3rds of American corporations did not pay any federal income tax between 2005 and the previous 7 years, says a new Congrerssional report. Now hold that thought and lets look at another facet of taxation. Way back in 1965 individuals paid 62% of the total tax revenue, but by 2000 that burden had grown to 82% and it’s even higher in 2008! And to make this tax structure even more weird, the top 10 percent of wage earners now pay 65 percent of the taxes and the bottom 50 percent pay a mere 3.7 percent. That’s almost like a dis-incentive, something counter productive for a capitalist society.
